Delray’s outside legal counsel to withdraw from suit against tennis tournament operator

After two years of litigating on behalf of the city of Delray Beach in its lawsuit against tennis tournament operator MatchPoint Inc., the city’s special counsel has filed a motion to withdraw from the case.

The Weiss, Serota, Helfman, Cole and Bierman law firm has been representing the city as its outside legal counsel in the case since March 2016.

In a hearing scheduled for 8 a.m. Tuesday at the Palm Beach County Courthouse, Judge G. Joseph Curley will hear two motions, one filed by the city to cancel a hearing scheduled for April 13 and one by the firm to withdraw from the case.

The hearing will take place in courtroom 10B.

It is unclear who the city will hire to replace the firm. The city could use its own legal team to pursue the case.

The city alleges in the lawsuit that the contract, which brings the Delray Beach Open to the city, should be voided because it wasn’t competitively bid.
